Terms and Conditions for Seasonal Spaces, LLC Pumpkin Porch Decorating Services
By purchasing our services, you (“Client” or “You”) agree to the following terms and conditions, effective upon purchase of any service package. Purchase constitutes acceptance of these terms. These terms govern the delivery, installation, and maintenance of pumpkin porch decorations, including pumpkins, mums, and other seasonal items provided by Seasonal Spaces, LLC (“We” or “Us”).
1. Service Description
We provide professional pumpkin porch decorating services, including selection, delivery, and arrangement of pumpkins, mums, and related décor. All items are natural and seasonal, subject to availability. Photos or descriptions are for illustrative purposes; actual items may vary in size, shape, or color.
2. Perishability and Rotting of Pumpkins
Pumpkins are natural, perishable products and may rot or deteriorate due to factors beyond our control, such as weather, temperature, sun exposure, pests, or handling. We make every effort to deliver fresh pumpkins, but we cannot guarantee their lifespan. Clients are advised to handle pumpkins carefully to avoid damage, as rough handling can accelerate rotting. If a pumpkin rots prematurely, we may offer a replacement as available, subject to stock and at our discretion. No refunds will be provided for natural decay.
3. Maintenance Requirements
To maximize the longevity of your display:
- Mums require daily watering to stay healthy. We recommend checking soil moisture and watering as needed, especially in dry or hot conditions.
- Protect the display from extreme weather, such as heavy rain, frost, or high winds, by covering or moving items indoors if possible.
Failure to maintain the display properly may result in quicker deterioration, for which we are not responsible.
4. Liability and Disclaimers
Our services may involve installing multiple pumpkins, straw bales, mums, and other decorations, which may reduce normal access to porches, walkways, or other areas. We are not responsible for any conditions resulting from the placement of these items, including but not limited to reduced accessibility, trips, falls, or other incidents. Additionally, we are not liable for any stains on concrete, porches, or other surfaces caused by pumpkins, mums, or any materials used in the display (including removable adhesives). Clients assume all risks associated with the display once installed, including but not limited to property damage, personal injury, or loss. We disclaim liability for any indirect, incidental, or consequential damages arising from the use or presence of our products. This includes natural decay, pest damage, or weather-related issues. We are not liable for damages unless caused by our proven negligence during delivery or installation.
5. Payments and Refunds
Full payment is due at booking. All sales are final, with no cancellations, refunds, or credits except in cases of non-delivery or defective items (excluding natural perishability). Refunds or credits are at our sole discretion.
6. General Provisions
These terms represent the entire agreement between you and us. We reserve the right to update them at any time. If any provision is found invalid, the remainder remains in effect. This agreement is governed by the laws of Salt Lake County, Utah.
